OFFICIAL CONTEST RULES  

NO PURCHASE NECESSARY. A PURCHASE WILL NOT IMPROVE ONE’S CHANCES OF WINNING: Open only to residents of the United States, except Florida, New York, Rhode Island, Washington and Puerto Rico, who are currently of the age of majority in their state of residence, and who have the capacity to enter into legally binding contracts and satisfy all eligibility requirements. Employees of the Richmond Times-Dispatch ("Sponsor") and its affiliates which are owned by BH Media Group, Inc., and members of their immediate families (spouse, parents, children, and siblings and their spouses) are not eligible. Void where prohibited. 

HOW TO ENTER:  Go to http://www.timesdispatch.com/contests/ and click on Can’t Buy Me Talent Contest ad to link to the entry form. Fill out the entry form giving name, address, email address, phone number and video embed link.  Winners will be selected based on the highest number of reader votes and through our panel of judges from all contest entries received (Feb. 2 - March 2, 2014). See SELECTION OF WINNERS below. To be entered into the contest, an entry must be received by 11:59 p.m., March. 2, 2014. Each timely submitted correct entry will be eligible for the contest.  Only one (1) video embed submission per entrant is allowed  

ORIGINAL WORK ONLY. An entrant in this contest may only submit a video for which the entrant owns all right, title and interest (including but not limited to copyright) to such video and any song or performance in the video. This means entrants may only submit song performances which are the original work of the entrant and the entrant must own the copyright to such song (score and lyrics) and must not have copied such song from any third party. No cover songs allowed. The entrant must have obtained the permission of all persons identifiable in the video to submit any video in this contest. Entrant represents and warrants (i) the video, song or performance is his/her original work, (ii) no part of the video, song or performance will infringe upon, violate or misappropriate the copyright or other rights of any third party, and (iii) the video, song or performance will not contain defamatory or libelous matter, or invade or intrude upon the privacy or publicity rights of any person.

ENTRY CONSTITUTES PERMISSION TO PUBLISH.  Any video submitted during the contest (and any information submitted by the entrant on the entry form) may be published in the Richmond Times-Dispatch newspaper, richmond.com, or in any other form of media, at any time and for any length of time, including but not limited to publication for any marketing, advertising or other form of promotion for this contest or similar future contest by the Sponsor, and publication does not entitle the entrant or any other person to any form of compensation.

Providing a video embed link in this contest constitutes the entrant’s representation that all of the conditions and requirements in these rules have been satisfied. Each entrant shall indemnify and hold the Sponsor harmless from claims of any third party relating to publication (in any form of media, including but not limited to publication in the Richmond Times-Dispatch newspaper or on its website richmond.com) of either the video or video embed link, including but not limited to claims that an entrant’s video, performance or song violates the intellectual property rights or privacy rights of any person or entity, or  the judges’ decisions regarding the entrant or entrant’s submission. By submitting any video or video embed link, the entrant grants Sponsor the rights and privileges set forth in these rules.

The Sponsor retains the discretion whether to publish a video embed link and may in its discretion elect not to publish a video embed link for any reason, including but not limited to any belief that a video or song may not be an original work. The Sponsor in its discretion may remove a video embed link and disqualify an entrant if the Sponsor believes a video or song is not original work.

By submitting an entry for this contest, participants agree to abide by these Official Rules and any decision Sponsor makes regarding this promotion. Sponsor reserves the right to remove a video submission from voting in its sole discretion and disqualify from the contest any participant or winner who, in Sponsor’s reasonable suspicion, violates these Official Rules.

This promotion and the rights and obligations of Sponsor and participants will be governed and controlled by the laws of the Commonwealth of Virginia, applicable to contracts made and performed in Virginia without reference to the applicable choice of law provisions. All actions, proceedings, and litigation relating to this contest or these official rules will be instituted and prosecuted solely within the Commonwealth of Virginia. The parties consent to the jurisdiction of the state courts of Virginia and federal courts located within the state and county with respect to any action, dispute, or other matter directly or indirectly pertaining to or arising out of this contest or promotion, these rules, any prize, or any acceptance, possession or use of any prize. Participants in this contest hereby waive any right to jury trial against Sponsor relating to this contest. With respect to any claim against Sponsor relating to this contest or any prize, any acceptance, possession or use of any prize, valid service of process and proper filing of any claim in a court of competent jurisdiction must occur within three (3) months of the date such claim accrued, or such claim shall be forever waived, barred and discharged.

Each winner will be notified by phone or e-mail within 48 hours of the drawing date. Any prize must be claimed or accepted within two business days of notification. All prizes are non-transferable. No cash or other substitutions are allowed.

SELECTION OF WINNERS /ELIGIBILITY AND PRIZE:
All entries must be received by 11:59 p.m. on March. 2, 2014 to be eligible for the prize drawing. No mass-produced or photocopied entries will be accepted. Entries that are incomplete, illegible or damaged are void and will not be accepted or eligible. Only legible and complete entry forms will be accepted and eligible. Sponsor is not responsible for misdirected, lost, late or damaged entries. All entries become the property of the Sponsor and will not be acknowledged or returned.  There will be four (4) winning categories in this contest: (1) Fan Favorite (selected by voters – awarded to entrant submission with the most votes in accordance with these rules);  (2) Jolly Good Performance!; (3) Grooviest Lyrics; and (4) Best Rockstar Look-a-like. With respect to the first category, persons may vote more than once. However, any use of robotic, macro, automatic, programmed or similar methods of voting will void all such votes, and may subject an entrant to disqualification. The last three category winners will be chosen by the Sponsor’s panel of judges: Dustin Fletcher Matthews, Andrew Cothern, Jessi Coble, and Ryan Kopacsi. The decisions of the judges’ panel are final and the judges’ decisions are solely within the discretion of the judges. If any judge is unavailable for any reason, the Sponsor reserves the right to appoint, in its discretion, an alternate judge, or proceed without such judge.

Winners may be required to sign an affidavit of eligibility prepared by Sponsor which confirms winner is eligible for the prize, has complied with and agrees to all contest rules, and failure to do so results in disqualification. After a winner has been notified, Sponsor retains the right to disqualify such person(s) (and declare another winner) if the Sponsor believes the submitted video or song was not original work or the person did not comply with these rules or have the right to submit the video embed link.

DISCLAIMER:
By entering this contest, each winner assumes all liability for any injury or damages caused or claimed to be caused by participation in the contest, the judges’ decisions, and/or the acceptance and/or use of any prize and releases the Sponsor and each of its respective owners, affiliates, officers, directors and employees, from any such liability. Entry constitutes permission (except where prohibited by law) to use winners' names and addresses for purposes of advertising promotion and publicity without compensation. Winners are responsible for payment of all taxes associated with receipt of any prize. 

MISCELLANEOUS:
Odds of winning depend upon the number of eligible entries. Sponsor reserves the right to withdraw the transmission of this promotion and award the prizes from among the eligible entries received prior to the date of the withdrawal. Entrants agree to abide by these Official Rules and by the decisions of the judges, whose decisions are final. Failure to comply with these rules may result in disqualification from this promotion. Sponsor reserves the right to permanently disqualify from this promotion any person it believes has violated these rules. 

If for any reason the contest is not capable of being conducted as planned due to any cause beyond the control of Sponsor, including but not limited to any event or cause which corrupts or affects the administration, security, fairness, integrity or proper conduct of the promotion, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the contest and disqualify any individual who may have caused any such problem. Sponsor assumes no responsibility for any theft or destruction, unauthorized access to, or alteration of entries. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, unauthorized access to, or alteration of entries. Sponsor is not responsible for any problem or technical malfunctions of any telephone network or lines, computer online systems, servers or provider, computer equipment, software, failure of any entry to be received by Sponsor on account of technical problems or delays, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this contest. CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. 

If a dispute arises regarding who submitted an entry, the entry will be deemed submitted by the person in whose name the entry was made. 

By entering this contest, each entrant agrees that (i) any and all disputes, claims, and causes of action arising out of or in connection with this contest, the judges’ decisions or any prize awarded, shall be resolved individually, without resort to any form of class action; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs, directly or indirectly associated with entering this contest, but in no event will attorneys' fees be awarded or recoverable; and (iii) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby knowingly and expressly waives all rights to, any damages other than actual out-of-pocket expenses. 

The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. IN NO EVENT SHALL SPONSOR BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL, INDIRECT, INCIDENTAL OR PUNITIVE DAMAGES, EVEN IF IT HAS BEEN ADVISED OF THE POSSIBILITY OF THE DAMAGES. IN ANY EVENT THE MAXIMUM AGGREGATE LIABILITY OF SPONSOR TO ANY PERSON DIRECTLY OR INDIRECTLY RELATING TO THIS CONTEST OR PROMOTION, THE JUDGES’ DECISIONS, OR THE AWARD, USE OR ENJOYMENT OF ANY PRIZE SHALL NOT EXCEED THE SUM OF $10.00.
